SELLERSBURG TOWN COUNCIL MEETING
September 10, 2007
TOWN COUNCIL MEETING:
The Sellersburg Town Council met on September
10, 2007, at the Sellersburg Town Hall. Present were President
Douglas J. Reiter, Vice President Michael N. Lockhart, Council
Member Michael J. Hostetler, Council Member Douglas C. Pixley,
Council Member Paul J. Rhodes, Town Attorney William P. McCall, III
and Clerk-Treasurer David L. Kinder.
CALL TO ORDER:
President Douglas J. Reiter called the meeting
to order at 7:00 P.M.
PRAYER:
Offered by Steven P. Kochersperger, Restoration
Christian Church.
PLEDGE OF ALLEGIANCE:
Offered by all present.
Michael J. Hostetler makes a motion to appoint
Tom McEwen and Randall W. Mobley to the Sellersburg Plan Commission
Board, seconded by Paul J. Rhodes. 5-aye, 0-nay, motion approved.
PRESIDENT REITER asks if everyone
has reviewed the minutes of the August 13, 2007 meeting.
Michael J. Hostetler makes a motion to approve
the minutes as written, seconded by Michael N. Lockhart. 5-aye,
0-nay, motion approved.
PRESIDENT REITER asks if everyone
has reviewed the claims as presented by the Clerk-Treasurer.
Michael J. Hostetler makes a motion to approve
payment of the claims as submitted, seconded by Paul J. Rhodes.
5-aye, 0-nay, motion approved.
PAUL J. RHODES makes a motion to
appoint Mary Beth Coffman as secretary of the Parks Board, seconded
by Michael N. Lockhart. 5-aye, 0-nay, motion approved.
WILLIAM P. McCALL, III (Town Attorney):
Presents EXECUTIVE ORDER NO. 2 OF THE PRESIDENT OF THE TOWN
COUNCIL OF SELLERSBURG, INDIANA reference economic development
income tax (EDIT) money.
The Council gives a verbal consensus for
President Reiter to sign the Executive Order.

The Sellersburg Town Council met on September
17,2007, at the Sellersburg Town Hall. Present were President
Douglas J. Reiter, Vice President Michael N. Lockhart, Council
Member Michael J. Hostetler, Council Member Douglas A. Pixley,
Council Member Paul J. Rhodes, Town Attorney William P. McCall, III
and Clerk-Treasurer David L. Kinder.

to order at 7:00 P.M.

PRESIDENT REITER recesses the
Special Meeting at 7:01 P.M. and immediately opens the Public
Hearing for the 2008 Town Budget.
Present for the public hearing was Kenneth
Alexander and Trinette Imhof.
MICHAEL N. LOCKHART makes a
motion to close the Public Hearing, seconded by Michael J.
Hostetler. 5-aye, 0-nay, motion approved and Public Hearing closed
at 7:28 P.M.
President re-opens the Special Meeting at 7:28
P.M.

2007-016, AN ORDINANCE OF THE TOWN OF SELLERSBURG, INDIANA
AUTHORIZING THE ISSUANCE OF ITS ECONOMIC DEVELOPMENT REVENUE BONDS,
SERIER 2007 (COMMUNITY MONTESSORI, INC. PROJECT),IN THE PRINCIPAL
AMOUNT OF $4,900,000.00 TO FINANCE THE COSTS OF THE ACQUISITION,
CONSTRUCTION, INSTALLATION AND EQUIPPING OF AN ECONOMIC DEVELOPMENT
FACILITY FOR COMMUNITY MONTESSORI, INC. AUTHORIZING THE EXECUTION
AND DELIVERY OF A BOND PURCHASE AND LOAN AGREEMENT WITH RESPECT TO
THE PROJECT AMONG THE TOWN OF SELLERSBURG, INDIANA, AS ISSUER,
MAINSOURCE BANK, AS PURCHASER, AND COMMUNITY MONTESSORI, INC., AS
BORROWER, PROVIDING FOR LOAN REPAYMENTS SUFFICIENT TO PAY THE
PRINCIPAL OF, AND INTEREST ON THE BONDS AS THE SAME BECOME DUE; AND

first reading at the July 9, 2007 Town Council Meeting.

TOWN COUNCIL SPECIAL MEETING:
The Sellersburg Town Council met on September 17, 2007, at the
Sellersburg Town Hall. Present were President Douglas J. Reiter,
Vice President Michael N. Lockhart, Council Member Michael J.
Hostetler, Council Member Douglas A. Pixley, , Town Attorney William
P. McCall, III and Clerk-Treasurer David L. Kinder.
Council Member Paul J. Rhodes was not in attendance.

the “BOT” contract and have the Council sign it tonight, seconded by

AUTHORIZING ZONING CHANGE WITHIN THE TOWN OF SELLERSBURG, INDIANA.
The property is known as the Grace Click properties located at 7311
and 7313 State Road 311. The Sellersburg Planning and Zoning
Commission approved this Zoning change from R-1 to B-2 September 17,
2007.

GREG DIETZ, (Chief, Sellersburg Fire Department), request an
emergency declaration to ban any open burning in the Town of
Sellersburg, except for charcoal or propane type outdoor grills.
PRESIDENT REITER pursuant to Indiana Code 10-14-3-29 issues
EXECUTIVE DISASTER EMERGENCY ORDER for the Town of Sellersburg; no
burning except for charcoal and propane grills.
PRESIDENT REITER proposes ORDINANCE 2007-025, ORDINANCE EXTABLISHING
A WASTEWATER TAP FEE FUND, A WASTEWATER EXPANSION FUND AND PARKS
DONATION FUND.

the first reading, seconded by Michael J. Hostetler. 4-aye, 0-nay,
motion approved.

WILLIAM P. McCALL, III, (Town Attorney) presents letter from Melissa
Woods, River Hills Economic Development Specialist, requesting the
Clerk-Treasurer sign a letter to Kathleen Sellersburg Town Council
Special Meeting

Weissenberger, Indiana Office of Community and Rural Affairs,
stating the Town has dedicated $12,000.00 (twelve thousand dollars)
as matching funds for a Community Development Block Grant for Storm
Water Drainage Analysis. This letter also requires a Resolution from
the Town dedicating these funds to this grant.
MICHAEL N. LOCKHART makes a motion to Approve RESOLUTION R2007-008
dedicating the $12,000.00 matching funds, seconded by Douglas A.
Pixley. 4-aye, 0-nay, motion approved and Resolution approved.
MICHAEL J. HOSTETLER makes a motion to adjourn the meeting, seconded
by Michael N. Lockhart. 4-aye, 0-nay, motion approved and meeting
