July 9, 2007

 

 

TOWN COUNCIL SPECIAL MEETING:

The Sellersburg Town Council met on July 9, 2007 at the Sellersburg Town Hall. Present were President Douglas J. Reiter, Vice President Michael N. Lockhart, Council Member Michael J. Hostetler, Council Member Douglas C. Pixley and Clerk-Treasurer David L. Kinder.

 

Council Member Paul J. Rhodes, Town Attorney William P. McCall, III were absent.

 

CALL TO ORDER:

President Reiter called the meeting to order at 6:00 P.M.

 

PRAYER:

Offered by Reverend Larry Poe, Faith Community Church.

 

PLEDGE OF ALLEGIANCE:

Offered by all present.

 

PRESIDENT REITER asks if everyone has reviewed the minutes of the June 25, 2007 meeting.

 

Michael N. Lockhart makes a motion to approve the minutes of the June 25, 2007 meeting as written, seconded by Douglas C. Pixley.  Motion approved, 3-aye, 0-nay, and 1-abstains.

 

PRESIDENT REITER asks if everyone has reviewed the claims as submitted by the Clerk-Treasurer.

 

Michael N. Lockhart makes a motion to approve the claims as submitted by the Clerk-Treasurer, seconded by Michael J. Hostetler.  4-aye, 0-nay, motion approved.

 

PRESIDENT REITER presents RESOLUTION R2007-005, PERF (Public Employees’ Retirement Fund) RESOLUTION AUTHORIZING AN AGENT TO ACCEPT PENSION LIABILITY ON BEHALF OF TOWN OF SELLERSBURG.

 

Michael J. Hostetler makes a motion to approve Resolution R2007-005 on the first reading, seconded by Michael N. Lockhart.  4-aye, 0-nay, motion approved.

 

 

WILLIAM L. SKEES, (Attorney-at-Law) representing Community Montessori, Inc and Barbara Fondren, Executive Director, Community Montessori, Inc. address the Council reference an ordinance authorizing the Town of Sellersburg to issue up to $4,9000,000 (four million nine hundred thousand dollars) in economic development revenue bonds for Community Montessori, Inc.  The Town of Sellersburg Economic Development Commission unanimously recommended Sellersburg Town Council Regular Meeting

approval of this request. 

 

Michael N. Lockhart makes a motion to consider ORDINANCE 2007-016, AN ORDINANCE OF THE TOWN OF SELLERSBURG, INDIANA AUTHORIZING THE ISSUANCE OF ITS ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES 2007 (COMMUNITY MONTESSORI, INC. PROJECT), IN THE PRINCIPAL AMOUNT OF $4,9000,000.00 TO FINANCE THE COSTS OF THE ACQUISITION, CONSTRUCTION, INSTALLATION AND EQUIPPING OF AN ECONOMIC DEVELOPMENT FACILITY

 

FOR COMMUNITY MONTESSORI, INC. AUTHORIZING THE EXECUTION AND DELIVERY OF A BOND PURCHASE AND LOAN AGREEMENT WITH RESPECT TO THE PROJECT AMONG THE TOWN OF SELLERSBURG, INDIANA, AS ISSUER, MAINSOURCE BANK, AS PURCHASER, AND COMMUNITY MONTESSORI, INC., AS BORROWER, PROVIDING FOR LOAN REPAYMENTS SUFFICIENT TO PAY THE PRINCIPAL OF, AND INTEREST ON THE BONDS AS THE SAME BECOME DUE; AND TAKING OTHER RELATED ACTION with good well payment of $1,225.00 (one thousand two hundred twenty-five dollars), seconded by Douglas C. Pixley.  4-aye, 0-nay, motion approved.

 

Michael N. Lockhart makes a motion to approve Ordnance 2007-016 on the first reading, seconded by Douglas C. Pixley.  4-aye, 0-nay, motion approved.

 

MR. SKEES states that Shaun Gibson, from the City of New Albany, will forward a letter from the City of New Albany and Floyd County approving Sellersburg to issue these Bonds.

TOWN COUNCIL SPECIAL MEETING:

The Sellersburg Town Council met on July 23, 2007 at the Sellersburg Town Hall. Present were President Douglas J. Reiter Vice President, Michael N. Lockhart Council Member Michael J. Hostetler, Council Member Douglas C. Pixley, Council Member Paul J. Rhodes, Town Attorney William P. McCall, III and Clerk-Treasurer David L. Kinder.

 

 

CALL TO ORDER:

President Douglas J. Reiter called the meeting to order at 7:06 P.M.

 

PRAYER:

Offered by Council Member Michael N. Lockhart.

 

PLEDGE OF ALLEGIANCE:

Offered by all present.

 

MICHAEL WHALEN, (Hinton-Corby Insurance) presents the proposal for Liability Insurance for the year, beginning, August 15, 2008 with an annual premium of $101,020.00 (one hundred one thousand twenty dollars).

 

Paul J. Rhodes makes a motion to approve the General Liability Insurance as presented by Hinton-Corby Insurance, seconded by Douglas C. Pixley.  5-aye, 0-nay, motion approved.

 

WILLIAM P. McCALL, III, (Town Attorney) presents CSX Rail Bore, Glenwood Farms,

(Agreement No. CSX-057197).  Attorney McCall states that the contractor Paul Primavera & Associates will pay all fees.

 

Michael N. Lockhart makes a motion to grant the agreement between the CSX Transportation Company and the Town of Sellersburg as written, provided the contractor pay the fee for the easement, seconded by Michael J. Hostetler.  5-aye, 0-nay, motion approved.

 

PRESIDENT REITER asks if everyone has reviewed the minutes of the July 9, 2007 Town Council Meeting.

 

Michael N. Lockhart makes a motion to approve the minutes, seconded by Michael J. Hostetler.

4-aye, 1 abstains, motion approved.

MICHAEL BROTZGE, (President Giraffe Document Solution), requesting the Town to write a letter to the Clark County Auditor requesting that his firm receive tax abatements for the years 2005, 2006 and 2007.  The abatement was granted, but someone in his firm failed to file the necessary paper work with the Town and the Auditor’s office.

 

Michael N. Lockhart makes a motion to write a letter to the County Auditor recommending that they be granted the past tax abatements, seconded by Paul J. Rhodes. 5-aye, 0-nay, motion approved.

 

PAUL J. RHODES, (Council Member) makes a motion to approve the purchase of a 2008 Ford F250 truck, seconded by Michael J. Hostetler.  5-aye, 0-nay, motion approved. 

 

VIRGIL BOLLY, (Attorney-at-Law) presents ORDINANCE 2007-017 requesting a rezoning for property on State Road 311 from R-1 to B-2.

 

Michael N. Lockhart makes a motion to approve ORDINANCE 2007-017, AN ORDINANCE AUTHORIZING ZONING CHANGE WITHIN THE TOWN OF SELLERSBURG, INDIANA, seconded by Michael J. Hostetler.  5-aye, 0-nay, motion approved.

 

PRESIDENT REITER requests the Council to consider the addition of two police officers, at no additional expense to the Town. The police department will take over animal control and public works will give up a salary.

 

Douglas C. Pixley makes a motion to approve the Chief of pursue the hiring of two additional police officers, seconded by Michael J. Hostetler. 5-aye, 0-nay, motion approved.

 

KENNETH J. ALEXANDER, (Public Works Director) the use of EDIT funds received by the Town.  He has discussed the matter with (H. J.) Umbaugh and Associates and they believe that the money can be used for both Water and Sewer if the plan is modified.

 

MICHAEL N. LOCKHART, (Council Member) makes a motion to change the Economic Development Plan to include water, street and sewer, seconded by Paul J. Rhodes.  5-aye, 0-nay, motion approved.

 

Michael N. Lockhart notifies the Council that Franklin Boggess will no longer serve on the Plan Commission and that a new member for that Commission needs to be appointed.
