SELLERSBURG TOWN COUNCIL MEETING
February 12, 2007
TOWN COUNCIL MEETING:
The Sellersburg Town Council met on February 12, 2007 at the
Sellersburg Town Hall. Present were President Douglas J. Reiter,
Vice President Michael N. Lockhart, Council Member Michael J.
Hostetler, Council Member Douglas C. Pixley, Council Member Paul J.
Rhodes, Town Attorney William P. McCall, III and Clerk-Treasurer
David L. Kinder.
CALL TO ORDER:
President Douglas J. Reiter called the meeting to order at 7:00 P.M.
PRAYER:
Offered by Reverend Gary Fenner, Calvary Christian Church.
PLEDGE OF ALLEGIANCE:
Offered by all present.
KEVIN WRIGHT, (Assistant Public Works Director) presents quotes from
Delta Services, LLC for two portable generators at Covered Bridge
Lift Station #1 and #2.
The quote for a Cummins 60DGCB 240V 3 PH portable generator rated at
60/55 Kw with built in 200A 3 pole breaker built-in, for Lift
Station #1, including Generator & Automatic Transfer Switch,
Materials and Labor is $31,443.00 (thirty-one thousand four hundred
forty-three dollars).
The quote for a Cummins 35DGBB 240V 3 Ph portable generator rated at
35/32Kw with 150A 3 pole breaker built-in for Lift Station #2,
including Generator & Automatic Transfer Switch, Material and Labor
is $27,463.00 (twenty-seven thousand four hundred sixty-three
dollars).
Michael N. Lockhart makes a motion to approve the purchase of
portable generator for Covered Bridge Lift Station #1 for $31,443.00
(thirty-0ne thousand four hundred forty-three dollars) and for
Covered Bridge Lift Station #2 for $27,463.00 (twenty-seven thousand
four hundred sixty-three dollars), seconded by Michael J. Hostetler.

President Reiter asks if Council Members have reviewed the minutes,
as written, for the January 22, 2007 Town Council Special Meeting?
Paul J. Rhodes states that the name of former Council Member
Trinette S. Imhof is still in the signature block and her name
should be removed and Douglas C. Pixley’s name be added.

Paul J. Rhodes makes a motion to accept the minutes with this
change, seconded by Michael N. Lockhart. 5-aye, 0-nay, motion
approved.
President Reiter asks if Council members have reviewed the claims as
submitted by the Clerk-Treasurer.
Michael J. Hostetler makes a motion to approve the claims as
submitted by the Clerk-Treasurer, seconded by Paul J. Rhodes. 5-aye,
0-nay, motion approved.
SHARON MARRA, (Clark County Solid Waste Management), addresses the
Council concerning curbside recycling. She recommends that the
Council approve curbside recycling another six months until December
31, 2007 and during that time another inter-local agreement will be
presented for your consideration.
Michael N. Lockhart makes a motion to extend the curbside recycling
for six months, expiring December 31, 2007, seconded by Douglas C.
Pixley. 5-aye, 0-nay, motion approved.
President Reiter presents ORDINANCE 2007-004, AN ORDINANCE
ESTABLISHING A “RAINEY DAY FUND” PURSUANT TO INDIANA CODE
36-1-8-5.1.
Michael N. Lockhart makes a motion to consider Ordinance 2007-004 on
the first reading, seconded by Michael J. Hostetler. 5-aye, 0-nay,
motion approved.

President Reiter presents ORDINANCE 2007-005, AN ORDINANCE FOR THE
TRANSFER OF APPROPRIATIONS REGARDING THE TOWN OF SELLERSBURG.
Paul J. Rhodes makes a motion to consider Ordinance 2007-005 on the
first reading, seconded by Michael N. Lockhart. 5-aye, 0-nay, motion
approved.

President Reiter presents an Annual Renewal Form, COBRA
ADMINISTRATION, from BMS, LLC. (Benefit Marketing Solutions)
Michael N. Lockhart makes a motion to approve the contract with BMS,
LLC, for administration of the Cobra Administration, seconded by
Douglas C. Pixley. 5-aye, 0-nay, motion approved.
KENNETH J. ALEXANDER, (Director of Public Works), presents a
Proclamation for the Silver Creek Small Varsity Cheerleaders, for
winning the National Championship, making Sellersburg Town Council

February 24th, 2007 as Silver Creek Competition Cheerleading Day.
Michael J. Hostetler makes a motion to approve the Proclamation,
seconded by Michael N. Lockhart. 5-aye, 0-nay, motion approved.
WILLIAM R. WHELAN, (Chief of Police): requests the Council to
appoint Patricia Clapp as secretary of the Police Commission.
Douglas C. Pixley makes a motion to approve Patricia Clapp as
secretary of the Police Commission retroactive to January 2007,
seconded by Paul J. Rhodes. 5-aye, 0-nay, motion approved.
WILLIAM P. McCALL, III, (Town Attorney), presents ORDINANCE
2007-006, AN ORDINANCE AMENDING ORDINANCE NUMBER 2007-003.
Michael N. Lockhart makes a motion to consider Ordinance 2007-006 on
the first reading, seconded by Michael J. Hostetler. 5-aye, 0-nay,
motion approved.

ASSIGN STREET ADDRESSES FOR ALL NEW DEVELOPMENT WITHIN THE TOWN OF
SELLERSBURG.

TOWN COUNCIL MEETING:
The Sellersburg Town Council met on February 26, 2007 at the
Sellersburg Town Hall. Present were President Douglas J. Reiter,
Vice President Michael N. Lockhart, Council Member Michael J.
Hostetler, Council Member Douglas C. Pixley, Council Member Paul J.
Rhodes, Town Attorney William P. McCall, III and Clerk-Treasurer
David L. Kinder.

President Douglas J. Reiter called the meeting to order at 7:00 P.M.

JONAS “Jay” TANNER, (Building Commissioner): Presents requests for
Tax Abatement for Vishnu (I) Incorporated (Comfort Inn), Tyler Rose
Properties, LLC and J. L. Gilbert Company Inc.
Michael N. Lockhart makes a motion to approve the tax abatements as
requested, seconded by Paul J. Rhodes. 5-aye, 0-nay, motion
approved.
President Reiter makes a motion to issue an American Flag that has
flown from the flagpole at the Sellersburg Police Department to the
daughter of John Harris, a police officer killed in the line of duty
and a plaque to be installed on the flagpole honoring Mr. Harris,
seconded by Michael N. Lockhart. 5-aye, 0-nay, motion approved.
